Taxi Services Terms and Conditions

Jupiter Taxi provides services based on the following terms and conditions, the service descriptions and the price lists. Differing terms and conditions do not apply, even if Jupiter Taxi does not expressly contradict them. Deviations from these conditions require the express written acceptance of Jupiter Taxi. A contract is only concluded if it is confirmed by Jupiter Taxi.

Scope of services

The scope of services is determined exclusively according to the written order confirmation from Jupiter Taxi or, secondarily, according to the written offer from Jupiter Taxi. Information contained in brochures, service catalogs, price lists and similar information is only binding to the extent that it is expressly referred to. Transport takes place in accordance with the regulations of the StVO and the PbefG. Passengers must adhere to instructions from Jupiter Taxi or the chauffeur. If guests act contrary to the instructions, or if they pose a risk according to the StVO or the safety of road traffic by interfering with the chauffeur, Jupiter Taxi is entitled to exclude them from transport. In this case, Jupiter Taxi charges the full fare including the fixed price or kilometer price and all ancillary and special services.

Airport pickup (airport transfer)

Any change to the agreed pick-up time, regardless of the reason, must be reported to Jupiter Taxi immediately. Damage caused by failure to notify us immediately will be borne by the customer.

Prices

The prices include the statutory sales tax at the respective statutory rate. The prices valid on the day of the booking confirmation apply. Flat-rate prices not listed in the price list can only be agreed in writing and only apply to the agreed travel date and rental period. Times and distances beyond this will be calculated according to the valid price list. Additional costs due to delays are borne by the customer, unless the delays are due to the fault of Jupiter Taxi or the chauffeur. The fare includes passenger transport with normal luggage; Taking along bulky goods requires a separate agreement.

Payment Terms

Jupiter Taxi reserves the right to charge a deposit of up to 50% of the total price before the start of the journey or to request a blank debit receipt from a valid credit card issued on Jupiter Taxi before accepting an order. Remaining payments are due for payment within the deadlines stated on the invoice. The timeliness of payment depends on the receipt of the amount for unconditional disposal by Jupiter Taxi. When paying by check, the claim is only considered paid once it has been fully credited. Payments are always used to settle the oldest debt. If the customer is in default of payment, Jupiter Taxi will charge interest of 5 percentage points above the base interest rate, subject to the assertion of further damages due to default. A €10 reminder fee will be charged for the second and each subsequent reminder. The customer reserves the right to prove lesser damage.

Cancellations and withdrawal

Cancellations will only be effective if they are made in writing or confirmed in writing by Jupiter Taxi if made verbally. The timeliness of written cancellations depends on access to Jupiter Taxi. Cancellations up to and including 24 hours before the contractually agreed start of the trip are free of charge. In the event of cancellations, Jupiter Taxi charges a portion of the basic trip price as compensation. This share is:

* 50% for cancellations up to 12 hours
* 80% for cancellations up to 3 hours before the contractually agreed start of performance
* 100% for later cancellations and if the journey does not start.

The customer is obliged to contact Jupiter Taxi immediately if he cannot find his chauffeur, whether at the airport or in the city. In the event that the customer does not contact us and the chauffeur cannot find the customer (or vice versa) and therefore the trip does not take place, the trip and, if applicable, the waiting time will be charged at 100%.

Expenses will be charged Jupiter Taxi regardless of the timeliness of cancellations if they have already occurred. The customer is expressly permitted to prove that Jupiter Taxi suffered no damage at all or that the damage was lower. Jupiter Taxi reserves the right to withdraw from the contract in whole or in part if the customer stops paying, becomes insolvent or, due to external circumstances, it can be assumed that the services are being used improperly, or the customer breaches an obligation incumbent on him according to these contractual provisions.

Obligations and liability of the customer

The customer immediately informs Jupiter Taxi of any change to his name, his (billing) address, his legal form and his bank details. The customer is also obliged to provide the necessary information about passengers, time and place of service provision. If the customer fails to provide immediate notification, he will be liable for damages that would have been avoided if notification had been made in a timely manner. The customer undertakes, also on behalf of the passengers, not to misuse the service of Jupiter Taxi, in particular

* not to disrupt or hinder the performance of the service
* not to cause any damage
* not to violate criminal law regulations
* to strictly adhere to the ban on smoking in the vehicle
* not to refuse to pay the fare.

If a customer violates the aforementioned obligations, Jupiter Taxi is entitled to take all necessary measures to eliminate the abuse. In the event of a culpable violation, the customer is liable to Jupiter Taxi for damages.

Liability of Jupiter Taxi

Jupiter Taxi is liable to the customer for damages - regardless of the legal basis - only in the event of intent or gross negligence or culpable violation of essential contractual obligations by Jupiter Taxi, its legal representatives or vicarious agents. Liability for injury to life, body or health is governed by statutory regulations. In the event of material damage, Jupiter Taxi's liability is limited to €1,000.00 per passenger. There is a liability violation for the vehicles in accordance with the applicable general insurance conditions. The customer must take care of any additional insurance themselves. Jupiter Taxi is not liable for missed appointments and their economic consequences, unless Jupiter Taxi is responsible for these. This includes, for example, delays/delays caused by:

* Traffic jams, road closures
* Vehicle breakdowns or traffic accidents
* Bad weather

For damages resulting from incorrect transmissions Data provided by the customer, Jupiter Taxi assumes no liability towards the customer or passenger.

Applicable Law and Place of Jurisdiction

Austrian law applies exclusively to all legal relationships between Jupiter Taxi and its customer. The place of jurisdiction and place of performance is Vienna.

Partial invalidity

If one or more of the above conditions are ineffective, the remaining conditions remain unaffected by the ineffectiveness. The statutory provisions take the place of invalid clauses.
